About Us
AvioTech IT Ltd was launched in the Isle of Man in April 2009 & is a sister Company of Aviotech (IOM) Ltd.
AvioTech IT was formed as a result of the experience gained supporting aviation and other airline operators when James Ross joined the team. Collectively AvioTech IT has a wealth of experience, aiming to give you some of the best IT support on the island. We have developed a broad range of customers in the short time we have been operating.

Warranties and Liability
1)AvioTech IT warrants that it will use reasonable care and skill in furnishing the services but does not warrant that the services will achieve any result other than any expressly specified in the proposal.
2)It is hereby expressly agreed by the client and AvioTech IT that AvioTech IT shall in no circumstances be liable whether in tort (including negligence or statutory duty), contract or otherwise for any financial, special or consequential loss (including any loss of revenues, anticipated savings, profits, business or contracts) arising from the provision of the services, or any defect therein or the delayed performance thereof by AvioTech IT.
3)AvioTech IT will indemnify the client against direct damage or injury to the client's property or person to the extent that such damage or injury is directly caused by the negligence of AvioTech IT's employees or agents in providing the services, by making good such damage to property or compensating personal injury provided that AvioTech IT's total liability for damage to property (including damage caused by breach of contract, tort and breach of statutory duty) shall Not exceed £50,000.
4)AvioTech IT's sole liability in respect of defective or delayed performance of the services shall be limited to making good at its own expense such defect or delay.
5)In the event that any defect or delay as referred to in clause 4 cannot be remedied, the liability of AvioTech IT shall not exceed the total amount of fees paid by the client for the services.
Client's Obligations
1)The client agrees to give AvioTech IT such information advice and assistance relating to the subject matter of the Proposal as AvioTech IT may reasonably require.
2)The Client shall be responsible to AvioTech IT for ensuring the accuracy of any information submitted by the client.
3)If any services are to be performed or information is to be supplied by AvioTech IT pursuant to or in accordance with any information or specification submitted by the client, the client shall indemnify AvioTech IT against all loss, damages, costs and expenses awarded against or incurred by AvioTech IT in settlement of any claim for infringement of any patent, copyright, design, trade mark or any other industrial or intellectual property rights of any other person which results from AvioTech IT's use of the client's information or specification.
4)The client shall indemnify and keep indemnified AvioTech IT its employees or agents against all claims, actions, losses, damages, costs and expenses which may be brought against or incurred or suffered by AvioTech IT employees or agents in connection with the carrying out of the services which arises as a result of or due to the negligence of the client its employees or agents.
5)Any property supplied to AvioTech IT by or on behalf of the client shall be held and worked upon by AvioTech IT at the client's risk. AvioTech IT shall not be liable for any loss or damage to any such property except to the extent such loss or damage was caused by the negligence of AvioTech IT's employees or agents.
Confidentiality
1)All information passing between the parties shall be deemed to have been furnished in confidence for the purposes authorised by the proposal and no other. The recipient party shall take all reasonable precautions to prevent communication of any such information to any of its employees or to any third party except as may be necessary in order to carry out the purposes of the proposal. If disclosure to an employee or a third party is necessary for such purposes then such employee or third party shall be required to observe the same confidentiality obligations as the recipient party.
2)Neither AvioTech IT nor the client shall use the name of the other in any publicity material nor publish anything relating to the services without the prior written permission of the other (such permission not to be unreasonably withheld or delayed).
3)AvioTech IT shall not be deemed to be in breach of its obligations by reason of any delay in performing, or any failure to perform, any of AvioTech IT's obligations in relation to the services, if failure was due to any cause beyond AvioTech IT's reasonable control.
Termination
1)Either party may terminate this Agreement if the other is in default in a matter of serious import to the aggrieved party provided that the aggrieved party has first given written notice of its intention to terminate within a time specified (not being less than 30 days) unless the default is remedied and on failure so to remedy the aggrieved party may forthwith by written notice terminate this agreement. Termination shall be without prejudice to any obligation by one party to the other which shall have accrued and owe prior thereto.
Arbitration
1)Any dispute arising concerning the provisions of this agreement or the services shall be referred to arbitration by a single arbitrator appointed by agreement of the parties hereto. Failing such agreement within 30 days of the request by one party to the other that a matter be referred to arbitration, such reference shall be to an arbitrator appointed by the Chartered Institute of Arbitrators.
Severability
1) If any condition or provision or any part of this agreement shall be declared void or unenforceable or become void unenforceable invalid or illegal for any reason whatsoever then the other conditions and provisions of the agreement shall remain in full force and effect in so far as the offending condition or provision can be severed and the remainder of the agreement can properly continue to operate.
2) No forbearance or indulgence by either party in enforcing any condition of this agreement shall prejudice or restrict that party's rights or powers under this agreement and no waiver of any breach shall operate as a waiver of any subsequent or continuing breach.
Law
1)These conditions together with the Proposal shall be governed by and construed in accordance with the Laws of the Isle of Man and the parties agree to submit to the jurisdiction of the Manx Courts
2)If the Company is subject of a proposal for voluntary arrangement; or has a petition for an administration order or a petition for a winding up order brought against it; or passes a resolution for a winding up order; or makes any composition, arrangement, conveyance or assignment for the benefit of its creditors, or purports to do so, or a receiver or any other person is appointed in respect of its undertaking or all or any of its property; or fails to comply with the provisions for payment provided for in this contract AvioTech IT shall without prejudice to any other rights that they may have under this contract be entitled to terminate this contract by notice in writing to the company. If the company merges with or is taken over by another person, firm, or company AvioTech IT reserves the right to terminate this contract without liability by notice in writing to the company. This contract may also be terminated in writing by either party in accordance with any express provision agreed in the documents forming the contract or by mutual consent.
